1 A bill to be entitled
2 An act relating to exploitation of elderly or
3 disabled adults; amending s. 775.15, F.S.;
4 revising the statute of limitations for
5 prosecutions for abuse, aggravated abuse, or
6 neglect of an elderly person or disabled adult;
7 specifying a statute of limitations for
8 prosecutions for exploitation of an elderly
9 person or disabled adult; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Paragraph (g) of subsection (2) of section
15 775.15, Florida Statutes, is amended to read:
16 775.15 Time limitations.--
17 (2) Except as otherwise provided in this section,
18 prosecutions for other offenses are subject to the following
19 periods of limitation:
20 (g) A prosecution for a felony violation of s. 825.102
21 or s. 825.103 must be commenced within 5 4 years after it is
22 committed.
23 Section 2. This act shall take effect October 1, 2002.

applicable to civil actions.

- Deletes the newly created language tolling the criminal
6 statute of limitations for exploitation.
7 - Extends the current 4-year felony statute of limitations
for physically abusing or neglecting an elderly person
8 or disabled adult to 5 years.
