  1                      A bill to be entitled

  2         An act relating to offenses involving vehicle

  3         identification numbers; amending s. 319.33,

  4         F.S.; revising the elements of the offense of

  5         possessing, selling or offering for sale,

  6         concealing, or disposing of a motor vehicle or

  7         mobile home, or major component part thereof,

  8         on which the motor number or vehicle

  9         identification number has been destroyed,

10         removed, covered, altered, or defaced;

11         providing penalties; providing an effective

12         date.

14  Be It Enacted by the Legislature of the State of Florida:

15

16         Section 1.  Paragraph (d) of subsection (1) and

17  subsection (6) of section 319.33, Florida Statutes, are

18  amended to read:

19         319.33  Offenses involving vehicle identification

20  numbers, applications, certificates, papers; penalty.--

21         (1)  It is unlawful:

22         (d)  To possess, sell or offer for sale, conceal, or

23  dispose of in this state a motor vehicle or mobile home, or

24  major component part thereof, on which any the motor number or

25  vehicle identification number that has been affixed by the

26  manufacturer or by a state agency, such as the Department of

27  Highway Safety and Motor Vehicles, which regulates motor

28  vehicles has been destroyed, removed, covered, altered, or

29  defaced, with knowledge of such destruction, removal,

30  covering, alteration, or defacement, except as provided in s.

31  319.30(4).

  1         (6)  Any person who violates any provision of this

  2  section is guilty of a felony of the third degree, punishable

  3  as provided in s. 775.082, s. 775.083, or s. 775.084.  Any

  4  motor vehicle used in violation of this section shall

  5  constitute contraband which may be seized by a law enforcement

  6  agency and shall be subject to forfeiture proceedings pursuant

  7  to ss. 932.701-932.704.  This section is not exclusive of any

  8  other penalties prescribed by any existing or future laws for

  9  the larceny or unauthorized taking of motor vehicles or mobile

10  homes, but is supplementary thereto.

11         Section 2.  This act shall take effect July 1, 2002.

14                          SENATE SUMMARY

15    With respect to the offense of possessing, selling or
      offering for sale, concealing, or disposing of a motor
16    vehicle or mobile home, or major component part thereof,
      on which the motor number or vehicle identification
17    number has been destroyed, removed, covered, altered, or
      defaced, revises the elements of the offense to provide
18    that the motor number or VIN must have been affixed by
      the manufacturer or by a state agency that regulates
19    motor vehicles.
