2 An act relating to electric power generating
3 plants; creating s. 403.5205, F.S.; providing
4 legislative findings; providing additional
5 conditions for locating simple cycle turbine
6 electric plants; providing eligibility for
7 cooperative-funding assistance for activities
8 designed to promote alternative water supplies;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 403.5205, Florida Statutes, is
14 created to read:
15 403.5205 Permitting requirements for simple cycle
16 turbine plants.--
17 (1) The Legislature finds that the recent rapid
18 expansion of proposed electric power plants that use simple
19 cycle turbine processes are not subject to the
20 regulatory-review requirements of the Florida Electrical Power
21 Plant Siting Act. The continued proliferation of these types
22 of plants will result in growth management problems for the
23 counties in which they are located and affect the patterns of
24 urban development and demands on water resources.
25 (2)(a) Plants are encouraged to locate in coastal
26 counties where they can be combined with reverse-osmosis
27 facilities or other similar technologies to desalinate water
28 resources to help meet potable water-supply needs.
29 (b) Plants that are proposed to be combined with
30 reverse-osmosis facilities or other similar desalination
31 technologies are eligible to receive cooperative-funding

1 assistance from water management districts created under
2 chapter 373 for those that have cooperative-funding-assistance
3 programs for activities designed to promote alternative water
4 supplies.
5 (3) Notwithstanding other requirements for permitting
6 required by law, construction permit applications for simple
7 cycle turbine electric plants must also demonstrate compliance
8 with the following conditions:
9 (a) A plant may not be located within 1 mile of
10 another existing electric generating plant whether it uses a
11 simple cycle turbine or other technology.
12 (b) A plant may not be located in a county in which
13 the electric generating capability of existing electric plants
14 that serve that county would be exceeded by 25 percent of the
15 electric power capability needed to serve the residents of
16 that county.
17 (c) A plant must demonstrate that the sole source of
18 its cooling water will be provided by the reuse of reclaimed
19 waste water in order to assure protection of groundwater and
20 surface water resources.
21 Section 2. This act shall take effect upon becoming a
22 law.
