3 Control District, Broward County; amending
4 chapter 98-501, Laws of Florida; providing for
5 the election of commissioners; providing for
6 redistricting of commissioners' zones;
7 providing for qualifying dates; revising
8 provisions relating to terms of office;
9 providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 4 of section 2 of chapter 98-501,
14 Laws of Florida, is amended to read:
15 Section 4. Board of Commissioners.
16 a. The governing board of the district shall be
17 designated as the board of commissioners of the Central
18 Broward Water Control District and shall be composed of six
19 members who shall be known as commissioners.
20 b. All commissioners shall be elected on an at-large
21 nonpartisan basis, by the qualified electors residing within
22 the district zone that the election is for, in accordance with
23 the procedure provided in this act. Commissioners from Zones
24 1, 2, and 3 shall be elected in the general election of
25 November 2002. Commissioners from Zones 4, 5, and 6 shall be
26 elected in the general election of November 2004. The
27 individual receiving the most votes who has qualified to run
28 as commissioner for a specific zone shall be elected
29 commissioner of that zone. No zone commissioner elected prior
30 to January 1, 2002, shall be affected in his or her term of

1 office. No district commissioner elected prior to July 1,
2 1987, shall be affected in his or her term of office.
3 c. The board of commissioners of the Central Broward
4 Water Control District shall hereafter be elected on a basis
5 of each of the six commissioners representing one of the six
6 respective geographical zones of the entire district as
7 provided herein. In qualifying for such office, each
8 candidate shall designate the zone he or she is qualifying
9 for.
10 d. The six zones of the entire district are as
11 follows:

13 Zone 1: Beginning at the intersection of the
14 north side of the north bank of the North New
15 River Canal with the West line of Section 3,
16 Township 50 South, Range 40 East, Broward
17 County, Florida; thence Southeasterly along
18 said north side of the north bank of the North
19 New River Canal, to the intersection with the
20 East line of Section 12, Township 50 South,
21 Range 40 East; thence Southerly, along said
22 East line of Section 12, to the Southeast
23 corner of said Section 12; thence Westerly,
24 along the South line of said Section 12, to the
25 Southwest corner of said Section 12; thence
26 Southerly, along the East line of Sections 14,

11 e. All commissioners shall serve a term of 4 years.
12 An election shall be held every 2 years to elect successors
13 for each group, so as to have the various successors elected
14 at the expiration of the term of the respective groups.
15 f. A commissioner shall, at the time of qualification
16 for office, be a resident of the respective zone that he or
17 she desires to represent for the 30 days immediately preceding
18 the date of qualifying for nomination to office. Qualifying
19 dates shall be the same as the qualifying dates for County
20 Commission for the general election. A commissioner at the
21 time of his or her qualification for office shall be a
22 qualified voter in Broward County.
23 g. The compensation of each commissioner shall be set
24 by appropriate resolution of the board of commissioners, but
25 shall not exceed $400 dollars per month. Expenses shall be
26 reimbursed pursuant to Florida Statutes pertaining to per diem
27 and travel expenses of public officers, employees, and
28 authorized persons, and any subsequent amendments thereto.
29 h. Whenever a commissioner shall be absent from every
30 commission meeting held in 2 consecutive calendar months, such
31 commissioner shall at the discretion of the board of

1 commissioners receive no compensation nor reimbursement of
2 expenses for the next succeeding 2-month period. Such period
3 shall be cumulative.
4 i. In the event that a vacancy should occur in the
5 office of a commissioner, the remaining commissioners shall
6 forthwith appoint by a majority vote a successor commissioner
7 having the same qualifications, including zone resident
8 requirements, as prescribed herein for the office vacated, for
9 the unexpired term. If the commissioners shall fail to
10 appoint a successor commissioner within 30 days after a
11 vacancy should occur, the Governor shall appoint a successor
12 commissioner for the unexpired term. There is no prohibition
13 on a commissioner succeeding himself or herself in term of
14 office.
15 j. Those commissioners holding office as of January 1,
16 2002 1998, shall serve their full 4-year term. Those
17 commissioners elected in 2002 and 2004 1998 and 2000 shall
18 assume office on the first Tuesday after the first Monday in
19 January following their elections and shall be installed at
20 the first regularly scheduled meeting in January following
21 their assumption of office and shall serve until the first
22 regular meeting following the first Tuesday after the first
23 Monday in November 2002 and 2004, respectively. Subsequently
24 elected commissioners shall assume office and shall be
25 installed at the first regularly scheduled meeting following
26 their election.
27 Section 2. This act shall take effect upon becoming a
28 law.
