14 On page 314, lines 10-27, delete those lines

16 and insert:
17 Section 113. Effective upon this act becoming a law,
18 section 1003.03, Florida Statutes, is created to read:
19 1003.03 Maximum class size.--
20 (1) Beginning with the 2002-2003 school year and
21 thereafter, the class size for each elementary school in each
22 school district in kindergarten through grade three may not
23 exceed 20 students, with a ratio of one full-time-equivalent
24 teacher per 20 students; however, in the case of critically
25 low-performing schools as identified by the Commissioner of
26 Education, the goal in kindergarten through grade three shall
27 be a ratio of one full-time equivalent teacher per 15
28 students. For purposes of any funding in the General
29 Appropriations Act to comply with this subsection, the
30 district shall give priority to identified critically
31 low-performing schools in the district. Second priority for

1 the use of any funds designated for complying with this
2 subsection shall be for kindergarten through grade one. Third
3 priority for the use of any funds designated for complying
4 with this subsection shall be for grades two and three.
5 (2) Beginning with the 2002-2003 school year and
6 thereafter, the class size for each school in each school
7 district in grades four through 12 may not exceed 25 students,
8 with a ratio of one full-time-equivalent teacher per 25
9 students.
