14         On page 314, lines 12-27, delete those lines
15  
16  and insert:  
17         1003.03  Maximum class size.--
18         (1)  The Legislature finds that investments in smaller
19  class sizes lead to high student achievement and higher
20  lifetime income and earning power. Therefore, to assure that
21  children attending public schools obtain a high quality
22  education as prescribed by the Florida Constitution, the
23  Legislature shall make adequate provision so that by 2010, the
24  maximum number of public school students who are assigned to
25  each core curriculum teacher in:
26         (a)  Prekindergarten through grade 3 does not exceed 18
27  students;
28         (b)  Grades 4 through 8 does not exceed 22 students;
29  and
30         (c)  Grades 9 through 12 does not exceed 25 students.
31         (2)  Beginning with the 2003-2004 fiscal year, the

SENATE AMENDMENT Bill No. CS for SB 2-D Amendment No. ___ Barcode 522556 1 State Board of Education shall include within its coordinated 2 budget request to the Legislature the specific amount of funds 3 necessary to reduce each district's class size by two 4 students. The request shall be made and the Legislature shall 5 act thereupon annually until such time as the maximum number 6 of students per core curriculum class does not exceed the 7 requirements of subsection (1). 8 (3) Beginning with the 2003 legislative session, the 9 Legislature shall take into consideration any recommendations 10 from the Maximum Class Size Funding Commission to determine a 11 stable source of state funds to implement the requirements of 12 this section. 13 Section 114. Maximum Class Size Funding Commission.-- 14 (1) Effective upon this act becoming a law, there is 15 created the Maximum Class Size Funding Commission. The 16 commission is assigned to the Department of Education for 17 administrative purposes. The commission shall consist of 17 18 members appointed as follows: 19 (a) Five members appointed by the Governor, at least 20 two of whom must be the parent of a child who attends a K 21 through 12 public school; 22 (b) Two members appointed by the President of the 23 Senate and two members appointed by the Speaker of the House 24 of Representatives; 25 (c) Two members appointed by each of the minority 26 leaders of the Senate and the House of Representatives; 27 (d) Two members appointed by the Secretary of 28 Education; 29 (e) A representative of the Florida School Boards 30 Association; 31 (f) A representative of the Florida Education 2 8:42 AM 04/03/02 s0002Dc1b-36j03
SENATE AMENDMENT Bill No. CS for SB 2-D Amendment No. ___ Barcode 522556 1 Association; 2 (g) A representative of the Office of Economic and 3 Demographic Research appointed by the director; and 4 (h) A representative of the Department of Bond Finance 5 appointed by the director. 6 (2) The commission shall choose a chairperson from 7 among its members who shall preside over meetings and perform 8 other duties required to administer this section. 9 (3) The commission shall hold its first meeting by 10 September 1, 2002, and shall meet as often as is practicable 11 to complete its task. The commission shall remain in existence 12 until it has completed its assignment as required by this 13 section but not later than June 30, 2004. 14 (4) The commission shall determine a stable source or 15 combination of sources of state funds sufficient to implement 16 section 1003.03, Florida Statutes. The commission may consider 17 all potential revenue-generating options, except that a 18 recommendation may not require a local funding source and may 19 not require any supplantation of funds from existing programs 20 or operations. 21 (5) The commission shall prepare a report detailing 22 its recommendations to the Governor, the President of the 23 Senate, and the Speaker of the House of Representatives by 24 February 1, 2003. If the Legislature choose to implement any 25 of the recommendations of the commission or any other 26 legislation that provides resources sufficient to meet the 27 requirements of section 1003.03, Florida Statutes, the 28 commission shall be considered abolished upon such legislation 29 becoming a law. The sum of $100,000 is appropriated from 3 the General Revenue Fund to the Maximum Class Size Funding 4 Commission for the 2002-2003 fiscal year.
