14         On page 14, lines 26-31, and on page 15, lines 1-11
15  remove:  all of said lines

17  and insert:  The Department of Health may provide information
18  contained in the electronic monitoring system to a licensed
19  health care practitioner for the purpose of providing
20  diagnostic or treatment services to an individual patient or
21  consumer under the practitioner's care. This subsection shall
22  not be construed to require the health care practitioner to
23  check the electronic monitoring system for every patient and
24  shall not be construed to create any obligation or liability
25  on the part of the health care practitioner.
26         (10)  The Department of Health shall submit a report to
27  the President of the Senate and the Speaker of the House of
28  Representatives by March 1, 2003, which recommends
29  performance-based measures for the electronic monitoring
30  system established under this section and provides the status
31  of implementation of the system. By July 1 of each year,

 1  beginning in 2004, the Department of Health shall report to
 2  the President of the Senate and the Speaker of the House of
 3  Representatives on the status of implementation of the
 4  electronic monitoring system. The annual report must include a
 5  report of the Department of Health's compliance with any
 6  performance-based measures established by the Legislature for
 7  the electronic monitoring system and other relevant statistics
 8  and information.
