17 Section 1. Miami-Dade County Home Rule Charter Study
18 Commission; purpose; membership; duties; expiration.--
19 (1) There is created within the Department of
20 Community Affairs the Miami-Dade County Home Rule Charter
21 Study Commission for the purpose of making findings and
22 recommendations regarding amendments or revisions to the
23 Miami-Dade County Home Rule Charter by special law of the
24 Legislature approved by vote of the electors.
25 (2)(a) The commission shall consist of 15 members: 4
26 members appointed by the Governor, 4 members appointed by the
27 President of the Senate, 4 members appointed by the Speaker of
28 the House of Representatives, and 3 members appointed by the
29 Board of County Commissioners of Miami-Dade County.
30 (b) Appointments to the commission shall be made
31 before August 1, 2002.

1 (c) Members of the commission shall serve without
2 compensation but are entitled to receive per diem and travel
3 expenses in accordance with section 112.061, Florida Statutes,
4 for the performance of their duties.
5 (3) The commission shall hold at least 6 public
6 hearings in Miami-Dade County for the purpose of receiving
7 testimony from expert witnesses, as well as testimony from the
8 citizens of Miami-Dade County, on issues related to amending
9 or revising the Home Rule Charter of Miami-Dade County by
10 special law of the Legislature approved by vote of the
11 electors.
12 (4)(a) Before June 1, 2003, the commission shall
13 submit a report of its findings and recommendations to the
14 Governor, the President of the Senate, the Speaker of the
15 House of Representatives, the mayor of Miami-Dade County, and
16 the members of the Board of County Commissioners of Miami-Dade
17 County.
18 (b) The report must include recommendations on whether
19 the Legislature should enact a special law amending or
20 revising the Home Rule Charter of Miami-Dade County, as well
21 as recommendations on the substance of any such proposed
22 amendments or revisions.
23 (c) The report, at a minimum, must also include:
24 1. Findings on the extent to which amendments or
25 revisions to the Home Rule Charter of Miami-Dade County are
26 necessary;
27 2. Findings on the fiscal impact associated with the
28 commission's recommended amendments or revisions to the
29 charter; and
30 3. Findings on any other factors the Legislature
31 should consider in determining whether to enact a special law

1 amending or revising the charter.
2 (d) If the electors of the state do not approve an
3 amendment to the State Constitution at the general election
4 held in November 2002, authorizing amendment or revisions to
5 the Miami-Dade Home Rule Charter by special law approved by
6 vote of the electors, the commission shall include in its
7 report findings and recommendations on whether the Legislature
8 should subsequently adopt a joint resolution during the 2004
9 Regular Session proposing such an amendment to the State
10 Constitution.
11 (5) The Department of Community Affairs shall provide
12 staff and other administrative support for the commission,
13 within existing resources.
14 (6) This section expires July 1, 2003.
15 Section 2. This act shall take effect upon becoming a
16 law.
