1 A bill to be entitled
2          An act relating to water resources; amending s. 373.036,
3    F.S.; requiring amendments to the water resource
4    implementation rule to be approved by the Legislature;
5    amending s. 373.1502, F.S.; providing for water
6    reservations to be adopted by rule; providing purposes;
7    amending s. 373.219, F.S.; excluding certain uses of
8    wastewater effluent from permit requirements; repealing s.
9    373.223(4), F.S., relating to reserving water from use by
10    permit applicants in certain locations and quantities;
11    providing an effective date.

13          Be It Enacted by the Legislature of the State of Florida:
14         
15          Section 1. Subsection (1) of section 373.036, Florida
16    Statutes, is amended to read:
17          373.036 Florida water plan; district water management
18    plans.--
19          (1) FLORIDA WATER PLAN.--In cooperation with the water
20    management districts, regional water supply authorities, and
21    others, the department shall develop the Florida water plan. The
22    Florida water plan shall include, but not be limited to:
23          (a) The programs and activities of the department related
24    to water supply, water quality, flood protection and floodplain
25    management, and natural systems.
26          (b) The water quality standards of the department.
27          (c) The district water management plans.
28          (d) Goals, objectives, and guidance for the development
29    and review of programs, rules, and plans relating to water
30    resources, based on statutory policies and directives. The state
31    water policy rule, renamed the water resource implementation
32    rule pursuant to s. 373.019(20), shall serve as this part of the
33    plan. Amendments or additions to this part of the Florida water
34    plan shall be adopted by the department as part of the water
35    resource implementation rule. In accordance with s. 373.114, the
36    department shall review rules of the water management districts
37    for consistency with this rule. Amendments to the water resource
38    implementation rule must be adopted by the secretary of the
39    department and be submitted to the President of the Senate and
40    the Speaker of the House of Representatives within 7 days after
41    publication in the Florida Administrative Weekly. Amendments
42    shall not become effective only upon approval by an actuntil
43    the conclusionof the next regular session of the Legislature
44    following their adoption.
45          Section 2. Subsection (4) is added to section 373.1502,
46    Florida Statutes, to read:
47          373.1502 Regulation of comprehensive plan project
48    components.--
49          (4) WATER RESERVATIONS.--Water reservations may be adopted
50    by rule to assist in the purposes of the comprehensive plan
51    defined in s. 373.470(2)(a) and the purposes provided in the
52    Federal Water Resource Development Act of 2000, including
53    restoring, preserving, and protecting the South Florida
54    ecosystem, ensuring that project components will be implemented
55    to achieve the purposes provided in the Federal Water Resource
56    Development Act of 1996 that include restoring, preserving, and
57    protecting the South Florida ecosystem, providing for the
58    protection of water quality in and the reduction of the loss of
59    fresh water from the Everglades, and providing such features as
60    are necessary to meet the other water-related needs of the
61    region, including flood control, the enhancement of water
62    supplies, and other objectives served by the project.
63          Section 3. Subsection (1) of section 373.219, Florida
64    Statutes, is amended to read:
65          373.219 Permits required.--
66          (1) The governing board or the department may require such
67    permits for consumptive use of water and may impose such
68    reasonable conditions as are necessary to assure that such use
69    is consistent with the overall objectives of the district or
70    department and is not harmful to the water resources of the
71    area. However, no permit shall be required for domestic
72    consumption of water by individual users or consumption or use
73    of domestic wastewater effluent subject to review under s.
74    403.064.
75          Section 4. Subsection (4) of section 373.223, Florida
76    Statutes, is repealed.
77          Section 5. This act shall take effect upon becoming a law.
