  1                      A bill to be entitled

  2         An act relating to airboats; amending s.

  3         327.65, F.S.; establishing a specific maximum

  4         noise level for airboats operated on state

  5         waters; providing an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8  

  9         Section 1.  Subsection (1) of section 327.65, Florida

10  Statutes, is amended to read:

11         327.65  Muffling devices.--

12         (1)  The exhaust of every internal combustion engine

13  used on any vessel operated on the waters of this state shall

14  be effectively muffled by equipment so constructed and used as

15  to muffle the noise of the exhaust in a reasonable manner;

16  however, airboats must be operated at a noise level no greater

17  than 90 dB at 50 feet.  The use of cutouts is prohibited,

18  except for vessels competing in a regatta or official boat

19  race, and for such vessels while on trial runs.

20         Section 2.  This act shall take effect July 1, 2003.
