1 A bill to be entitled
2 An act relating to registration of trademarks
3 and service marks; amending s. 495.071, F.S.;
4 revising the procedure by which the Department
5 of State must notify registrants of marks that
6 are expiring; providing an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Subsection (3) of section 495.071, Florida
11 Statutes, is amended to read:
12 495.071 Duration and renewal.--
13 (3) The Department of State shall notify registrants
14 of marks hereunder of the necessity of renewal within the year
15 next preceding the expiration of the 10 years following from
16 the date of registration by mailing a renewal notice by
17 certified mail, return receipt requested, to the registrant's
18 current address on file with the department. The current
19 address for a business organization is the address on the most
20 recent annual report required by s. 607.1622, s. 608.4511, or
21 s. 620.177 writing to the last known address of the
22 registrants. The department shall prescribe the forms on which
23 to make the required notification and the renewal called for
24 in subsection (1) and may substitute the uniform business
25 report, pursuant to s. 606.06, as a means of satisfying the
26 requirement of this part.
27 Section 2. This act shall take effect July 1, 2003.

certified mail the next year preceding the expiration of
