1 A bill to be entitled
2          An act relating to a public records exemption for certain
3    information regarding an applicant for federal, state, or
4    local housing assistance programs; amending s. 119.07,
5    F.S.; narrowing the public records exemption; removing the
6    exemption for bank account numbers, credit card numbers,
7    and telephone numbers of applicants and participants in
8    such programs; adding clarifying language; making
9    editorial changes; removing superfluous language; removing
10    the October 2, 2003, repeal thereof scheduled pursuant to
11    the Open Government Sunset Review Act of 1995; providing
12    an effective date.

14          Be It Enacted by the Legislature of the State of Florida:
15         
16          Section 1. Notwithstanding the October 2, 2003, repeal of
17    said paragraph scheduled pursuant to the Open Government Sunset
18    Review Act of 1995, paragraph (bb) of subsection (3) of section
19    119.07, Florida Statutes, is amended to read:
20          119.07 Inspection, examination, and duplication of
21    records; exemptions.--

23          (bb)1. Medical history records, bank account numbers,
24    credit card numbers, telephone numbers,and information related
25    to health or property insurance provided to the Department of
26    Community Affairs, the Florida Housing Finance Corporation, a
27    county, a municipality, or a local housing finance agency
28    furnished by an applicant for or a participant in aindividual
29    to any agency pursuant tofederal, state, or local housing
30    assistance programprogramsare confidential and exempt from the
31    provisions of subsection (1) and s. 24(a), Art. I of the State
32    Constitution. Any other information produced or received by any
33    private or public entity in direct connection with federal,
34    state, or local housing assistance programs, unless the subject
35    of another federal or state exemption, is subject to subsection
36    (1).
37          2. Governmental entitiesagencies or their agents shall
38    have access to such confidential and exempt records and
39    informationare entitled to access to the records specified in
40    this paragraph for the purposepurposesof auditing federal,
41    state, or local housing programs or housing assistance programs.
42    Such confidential and exempt records and information may be used
43    by an agency, as needed,in any administrative or judicial
44    proceeding, provided such records are kept confidential and
45    exempt,unless otherwise ordered by a court.
46          3. This paragraph is repealed effective October 2, 2003,
47    and must be reviewed by the Legislature before that date in
48    accordance with s. 119.15, the Open Government Sunset Review Act
49    of 1995.
50          Section 2. This act shall take effect October 1, 2003.
