15          Remove line(s) 53 through 57, and insert:

17          Art. I of the State Constitution. Upon request, the panel,
18    agency, or department shall disclose protected personal health
19    information in its possession to a managed care entity, where
20    the protected personal health information identifies a
21    subscriber in an ongoing grievance before the panel, agency, or
22    department, or proceedings incident thereto, and the subscriber
23    has made a written authorization during the panel grievance
24    process for the release of such information if, at the time of
25    the request for the information, the managed care entity has a
26    grievance before the panel regarding the subscriber or there is
27    an ongoing procedure incident thereto. The subscriber, upon
28    request, shall have access to all protected personal health
29    information in the possession of the panel, agency, or
30    department.
