Remove line(s) 53 through 57, and insert: |

Art. I of the State Constitution. Upon request, the panel, |
18
|
agency, or department shall disclose protected personal health |
19
|
information in its possession to a managed care entity, where |
20
|
the protected personal health information identifies a |
21
|
subscriber in an ongoing grievance before the panel, agency, or |
22
|
department, or proceedings incident thereto, and the subscriber |
23
|
has made a written authorization during the panel grievance |
24
|
process for the release of such information if, at the time of |
25
|
the request for the information, the managed care entity has a |
26
|
grievance before the panel regarding the subscriber or there is |
27
|
an ongoing procedure incident thereto. The subscriber, upon |
28
|
request, shall have access to all protected personal health |
29
|
information in the possession of the panel, agency, or |
30
|
department.
