2 An act relating to water use and impoundment
3 construction permits; amending s. 373.116,
4 F.S.; providing for notice by electronic mail;
5 requiring that permits contain certain
6 specified language; providing an effective
7 date.

9 Be It Enacted by the Legislature of the State of Florida:

11 Section 1. Section 373.116, Florida Statutes, is
12 amended to read:
13 373.116 Procedure for water use and impoundment
14 construction permit applications.--
15 (1) Applications for water use permits, under part II
16 of this chapter; for permits for construction or alteration of
17 dams, impoundments, reservoirs, and appurtenant works, under
18 part IV of this chapter; and for permits under s. 403.812
19 shall be filed with the water management district on
20 appropriate forms provided by the governing board.
21 (2) Upon receipt of an application for a permit of the
22 type referred to in subsection (1), the governing board shall
23 cause a notice thereof to be published in a newspaper having
24 general circulation within the affected area. In addition, the
25 governing board shall send, by regular or electronic mail, a
26 copy of such notice to any person who has filed a written
27 request for notification of any pending applications affecting
28 this particular designated area. Upon written request, Notice
29 of application for the consumptive use of water shall be
30 mailed by regular mail to the county and appropriate city

1 government from which boundaries the withdrawal is proposed to
2 be made.
3 (3) All permits issued under this section shall
4 include the following language:
5 This permit does not convey to the permittee
6 any property rights or privileges other than
7 those specified herein, nor relieve the
8 permittee from complying with any applicable
9 local government, state, or federal law, rule,
10 or ordinance.
11 Section 2. This act shall take effect upon becoming a
12 law.
