  1                      A bill to be entitled

  2         An act relating to the operation of

  3         motorcycles; amending s. 316.209, F.S.;

  4         providing that certain prohibitions concerning

  5         the operation of motorcycles do not apply to

  6         firefighters in the performance of their

  7         official duties; providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 316.209, Florida Statutes, is

12  amended to read:

13         316.209  Operating motorcycles on roadways laned for

14  traffic.--

15         (1)  All motorcycles are entitled to full use of a lane

16  and no motor vehicle shall be driven in such manner as to

17  deprive any motorcycle of the full use of a lane. This

18  subsection shall not apply to motorcycles operated two abreast

19  in a single lane.

20         (2)  The operator of a motorcycle shall not overtake

21  and pass in the same lane occupied by the vehicle being

22  overtaken.

23         (3)  No person shall operate a motorcycle between lanes

24  of traffic or between adjacent lines or rows of vehicles.

25         (4)  Motorcycles shall not be operated more than two

26  abreast in a single lane.

27         (5)  Subsections (2) and (3) do shall not apply to

28  police officers or firefighters in the performance of their

29  official duties.

 1         (6)  A violation of this section is a noncriminal

 2  traffic infraction, punishable as a moving violation as

 3  provided in chapter 318.

 4         Section 2.  This act shall take effect upon becoming a

 5  law.

 9    Provides that provisions relating to the operation of
      motorcycles on roadways laned for traffic are
10    inapplicable to firefighters in the performance of their
      official duties.
