1 A bill to be entitled
2 An act relating to crimes against children;
3 creating s. 938.10, F.S.; imposing an
4 additional court cost against persons who plead
5 guilty or nolo contendere to, or who are found
6 guilty of, certain crimes against minors;
7 requiring the clerk of the court to deposit the
8 proceeds of the court cost into the State
9 Treasury for deposit into a specified trust
10 fund to be used to fund children's advocacy
11 centers; requiring the clerk of the court to
12 retain a portion of the court cost as a service
13 charge; providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Section 938.10, Florida Statutes, is
18 created to read:
19 938.10 Additional court cost imposed in cases of
20 certain crimes against minors.--
21 (1) If a person pleads guilty or nolo contendere to,
22 or is found guilty of, regardless of adjudication, any offense
23 against a minor in violation of s. 784.085, chapter 787,
24 chapter 794, s. 796.03, s. 800.04, chapter 827, s. 847.0145,
25 or s. 985.4045, the court shall impose a court cost of $101
26 against the offender in addition to any other cost or penalty
27 required by law.
28 (2) Each month the clerk of the court shall transfer
29 the proceeds of the court cost, less $1 from each sum
30 collected, which the clerk shall retain as a service charge,
31 to the State Treasury for deposit into the Child Advocacy

1 Trust Fund for disbursement to child advocacy centers that are
2 members of the Florida Network of Children's Advocacy Centers,
3 Inc.
4 Section 2. This act shall take effect July 1, 2003.

7 SENATE SUMMARY
8 Imposes an additional court cost of $101 against persons
who plead guilty or nolo contendere to, or who are found
9 guilty of, certain sexual offenses against minors.
Provides for deposit of the proceeds of the court cost
10 into a trust fund to be used to fund children's advocacy
centers. Provides for the clerk of the court to retain $1
11 of each sum collected as a service charge.
