  1                      A bill to be entitled

  2         An act relating to sexual predators; amending

  3         s. 775.21, F.S.; requiring the Department of

  4         Law Enforcement to classify each offender

  5         designated as a sexual predator for purposes of

  6         community and public notification; specifying

  7         five levels of dangerousness; providing

  8         criteria for classifying sexual predators;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Paragraph (e) is added to subsection (7) of

14  section 775.21, Florida Statutes, to read:

15         775.21  The Florida Sexual Predators Act; definitions;

16  legislative findings, purpose, and intent; criteria;

17  designation; registration; community and public notification;

18  immunity; penalties.--

19         (7)  COMMUNITY AND PUBLIC NOTIFICATION.--

20         (e)  For purposes of community and public notification,

21  the department shall classify a sexual predator according to

22  his or her level of dangerousness. The levels of

23  classification are as follows:

24         1.  Level 1 applies to an offender who was within 10

25  years of age to the age of his or her underage victim and the

26  sexual activity was consensual.

27         2.  Level 2 applies to an offender who was in

28  possession of child pornography at the time of his or her

29  arrest for the offense.

  1         3.  Level 3 applies to an offender who was under the

  2  custody or supervision of the Department of Corrections at the

  3  time of the offense.

  4         4.  Level 4 applies to an offender who contacted the

  5  victim through use of the Internet, traveled to meet the

  6  victim, but did not have direct contact with the victim.

  7         5.  Level 5 applies to an offender who has committed

  8  any prior offense for which the offender may be designated as

  9  a sexual predator.

10         Section 2.  This act shall take effect July 1, 2003.

14    Requires that the Department of Law Enforcement classify
