An act relating to Central County Water Control District, |

Hendry County; amending ch. 2000-415, Laws of Florida; |

requiring that the supervisors of the district be elected |
5
|
by a vote of qualified electors residing in the district; |

|
establishing procedures and extending certain supervisor |
7
|
terms for the implementation of this act; providing an |
8
|
effective date. |

Be It Enacted by the Legislature of the State of Florida: |
11
|
|

|
Section 1. Section 9 of section 3 of chapter 2000-415, |
13
|
Laws of Florida, is amended to read: |
14
|
Section 9. Board of supervisors membership.-- |
15
|
(1) Definition.-- As used in this section, the term |
16
|
"qualified elector" means any person at least 18 years of age |
17
|
who is a citizen of the United States, a permanent resident of |
18
|
Florida, and a resident of the district who registers with the |
19
|
Supervisor of Elections of Hendry County in accordance with the |
20
|
election laws of this state.
|

|
(2) Composition of board of supervisors.--
|
22
|
(a)The number of members of the district board of |
23
|
supervisors shall be 5. At each annual meeting of the district, |
24
|
two supervisors will be elected for 3-year terms, except that in |
25
|
elections held at the annual meetings in 2000 and every third |
26
|
year thereafter on supervisor will be elected for a 3-year term. |
27
|
(b) The board members shall be elected by the qualified |
28
|
electors of the district in accordance with the laws of Florida |
29
|
governing nonpartisan elections. |

|
(c) Supervisors shall be qualified electors of the |
31
|
district. |

(3) Terms of office.-- |
33
|
(a) Each supervisor elected by qualified electors shall |
34
|
serve a term of 4 years. |

|
(b) The terms of each supervisor of the district holding |
36
|
office on the effective date of this act shall be extended until |
37
|
the second Tuesday following the next general election held |
38
|
after said supervisor's term would have otherwise expired.
|

(c) If a vacancy occurs in a seat occupied by a governing |
40
|
board member, the remaining members of the board of supervisors |
41
|
shall, within 60 days of receipt of a resignation or notice of a |
42
|
member's death or other disqualification, appoint a person who |
43
|
would be eligible to hold the office until the next general |
44
|
election held at least 160 days after the appointment. At such |
45
|
election, a supervisor shall be elected for the remainder of the |
46
|
term of the vacating member. |

|
Section 2. Section 1 of this act shall take effect only |
48
|
upon its approval by a majority vote of the qualified electors |
49
|
of the district, as defined in this act, to be held at the |
50
|
district's annual meeting in April, 2003, except that section 2 |
51
|
of this act shall take effect upon becoming a law. |
