A joint resolution proposing an amendment to Section 2 of |

Article I of the State Constitution to prohibit depriving |

a person of any right because of mental disability, as |

defined by general law. |

Be It Resolved by the Legislature of the State of Florida: |

|
That the amendment to Section 2 of Article I of the State |
19
|
Constitution set forth below is agreed to and shall be submitted |
20
|
to the electors of Florida for approval or rejection at the |
21
|
general election to be held in November 2004: |

ARTICLE I |

DECLARATION OF RIGHTS |

|
SECTION 2. Basic rights.--All natural persons, female and |
25
|
male alike, are equal before the law and have inalienable |
26
|
rights, among which are the right to enjoy and defend life and |
27
|
liberty, to pursue happiness, to be rewarded for industry, and |
28
|
to acquire, possess and protect property; except that the |
29
|
ownership, inheritance, disposition and possession of real |
30
|
property by aliens ineligible for citizenship may be regulated |
31
|
or prohibited by law. No person shall be deprived of any right |
32
|
because of race, religion, national origin, or physical or |
33
|
mental disability, as the term “mental disability” may be |
34
|
defined by general law. |

BE IT FURTHER RESOLVED that the title and substance of the |
36
|
amendment proposed herein shall appear on the ballot as follows: |

Proposes an amendment to Section 2 of Article I of the |
