6          The Committee on Judiciary recommends the following:

9          Remove the entire joint resolution and insert:
10 House Joint Resolution
11          A joint resolution proposing an amendment to Section 2 of
12    Article I of the State Constitution to prohibit depriving
13    a person of any right because of mental disability, as
14    defined by general law.
15         
16          Be It Resolved by the Legislature of the State of Florida:
17         
18          That the amendment to Section 2 of Article I of the State
19    Constitution set forth below is agreed to and shall be submitted
20    to the electors of Florida for approval or rejection at the
21    general election to be held in November 2004:
22 ARTICLE I
23 DECLARATION OF RIGHTS
24          SECTION 2. Basic rights.--All natural persons, female and
25    male alike, are equal before the law and have inalienable
26    rights, among which are the right to enjoy and defend life and
27    liberty, to pursue happiness, to be rewarded for industry, and
28    to acquire, possess and protect property; except that the
29    ownership, inheritance, disposition and possession of real
30    property by aliens ineligible for citizenship may be regulated
31    or prohibited by law. No person shall be deprived of any right
32    because of race, religion, national origin, or physical or
33    mental disability, as the term “mental disability” may be
34    defined by general law.
35          BE IT FURTHER RESOLVED that the title and substance of the
36    amendment proposed herein shall appear on the ballot as follows:
37 BASIC RIGHTS FOR PERSONS WITH DISABILITIES
38          Proposes an amendment to Section 2 of Article I of the
39    State Constitution to prohibit depriving a person of any right
40    because of mental disability, as the term “mental disability”
41    may be defined by general law.
