| 1 | A bill to be entitled | ||
| 2 | An act relating to bus transportation; amending s. 316.70, | ||
| 3 | F.S.; requiring the driving records of nonpublic sector | ||
| 4 | bus drivers to be checked for suspended or revoked | ||
| 5 | licenses; providing that private school students may ride | ||
| 6 | on public school buses and public school students may ride | ||
| 7 | on private school buses, subject to specified conditions; | ||
| 8 | providing an effective date. | ||

| 10 | Be It Enacted by the Legislature of the State of Florida: | ||
| 11 | |||
| 12 | Section 1. Paragraph (d) is added to subsection (1) of | ||
| 13 | section 316.70, Florida Statutes, to read: | ||
| 14 | 316.70 Nonpublic sector buses; safety rules.-- | ||
| 15 | (1) The Department of Transportation shall establish and | ||
| 16 | revise standards to assure the safe operation of nonpublic | ||
| 17 | sector buses, as defined in s. 316.003(78), which standards | ||
| 18 | shall be those contained in 49 C.F.R. parts 382, 385, and 390- | ||
| 19 | 397 and which shall be directed towards assuring that: | ||
| 20 | (d) The driving records of drivers of nonpublic sector | ||
| 21 | buses are checked by their employers at least once each year to | ||
| 22 | ascertain whether the driver has a suspended or revoked driver's | ||
| 23 | license. | ||
| 24 | Section 2. Private school students may be transported on | ||
| 25 | public school buses and public school students may be | ||
| 26 | transported on private school buses when there is mutual | ||
| 27 | agreement between the local school board and the applicable | ||
| 28 | private school. Any agreement for private school students to be | ||
| 29 | transported on public school buses must be in accordance with | ||
| 30 | sections 768.28(9)(a) and 316.6145, Florida Statutes. Any | ||
| 31 | agreement for public school students to be transported on | ||
| 32 | private school buses must be contingent on the private school | ||
| 33 | bus driver's having adequate liability insurance through his or | ||
| 34 | her employer. | ||
| 35 | Section 3. This act shall take effect July 1, 2003. | ||
