17	Statutes, is amended to read:
18	408.034 Duties and responsibilities of agency; rules.--
19	(5) The agency shall establish by rule a nursing-home-bed-
20	need methodology that has a goal of maintaining a district
21	average occupancy rate of 94 percent and thatreduces the
22	community nursing home bed need for the areas of the state where
23	the agency establishes pilot community diversion programs
24	through the Title XIX aging waiver program.
