  1                      A bill to be entitled

  2         An act relating to the local government

  3         half-cent sales tax; amending s. 218.62, F.S.;

  4         amending the distribution formula for proceeds

  5         from the tax; providing for retroactivity;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Section 218.62, Florida Statutes, is

11  amended to read:

12         218.62  Distribution formulas.--

13         (1)  Each participating county and municipal government

14  shall receive a proportion of moneys earmarked for

15  distribution within that county.

16         (2)  The proportion for each county government shall be

17  computed by dividing the sum of the unincorporated area

18  population plus two-thirds of the incorporated area population

19  by the sum of the total county population plus two-thirds of

20  the incorporated area population.

21         (3)  The proportion for each municipal government shall

22  be computed by dividing the population of that municipality by

23  the sum of the total county population plus two-thirds of the

24  incorporated area population.

25         (4)  Effective October 1, 2000, the apportionment

26  factors shall, except in the case of error in the population

27  certified pursuant to s. 186.901, remain in effect for the

28  fiscal year. Adjustments to distributions to correct errors

29  shall be made subsequent to receipt of a corrected population

30  certified pursuant to s. 186.901.

 1         Section 2.  This act shall take effect upon becoming a

 2  law and shall apply retroactively to October 1, 2000.

 4          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
 5                         Senate Bill 1126

 6                                 

 7  The Committee Substitute differs from the bill as filed in
    that it allows the Department of Revenue to correct municipal
 8  distributions, as well as county distributions, of the
    Half-Cent Sales Surtax proceeds when errors are made in the
 9  calculations.
