6          The Committee on Future of Florida's Families recommends the
7    following:

12 A bill to be entitled
13          An act relating to recreational activities at facilities
14    for elderly or disabled adults; authorizing bingo games
15    for residents or clients of certain facilities for the
16    elderly or disabled and for their guests; providing
17    conditions; providing for use of proceeds; providing
18    exemption from local regulation and fees; providing an
19    effective date.

21          Be It Enacted by the Legislature of the State of Florida:
22         
23          Section 1. Notwithstanding the provisions of section
24    849.0931, Florida Statutes, bingo games for residents or clients
25    of a facility licensed or authorized under part II, part III, or
26    part V of chapter 400, Florida Statutes, chapter 651, Florida
27    Statutes, or section 430.206, Florida Statutes, and for their
28    guests, or for residents of government-financed, government-
29    insured, or government-subsidized housing for the elderly and
30    their guests, may be conducted if such games are held in the
31    facility, played exclusively by residents or clients and their
32    guests, and conducted by residents, staff, or volunteers of the
33    facility, and if neither the facility nor any third party
34    derives financial benefit from such games. Games conducted for
35    residents or clients with a diagnosis of Alzheimer's Disease
36    which are played with the personal funds of residents or clients
37    must be supervised by paid or volunteer staff. Prizes may be
38    claimed only by residents or clients of these facilities or by
39    guests who are residents or clients of other similarly licensed
40    or authorized facilities. Any net proceeds remaining after
41    prizes are awarded may be donated by the residents' council to
42    projects or activities of their choice. Any county or
43    municipality that regulates the playing of bingo must exempt
44    bingo games conducted pursuant to this section from regulation
45    and fees.
46          Section 2. This act shall take effect July 1, 2003.
