1 A bill to be entitled
2         An act relating to infant eye care; amending s. 383.04,
3   F.S.; requiring certain eye examinations for all infants
4   born in hospitals in the state; reenacting s. 383.07,
5   F.S., relating to a penalty; amending ss. 627.6416 and
6   641.31, F.S.; providing that coverage for children under
7   health insurance policies and health maintenance
8   organization contracts include certain eye examinations
9   for infants and children; providing an effective date.

11         Be It Enacted by the Legislature of the State of Florida:
12         
13         Section 1. Section 383.04, Florida Statutes, is amended to
14   read:
15         383.04 Prophylactic required for eyes of infants.--Every
16   physician, midwife, or other person in attendance at the birth
17   of a child in the state is required to instill or have instilled
18   into the eyes of the baby within 1 hour after birth an effective
19   prophylactic recommended by the Committee on Infectious Diseases
20   of the American Academy of Pediatrics for the prevention of
21   neonatal ophthalmia.In addition, every baby born in a hospital
22   in the state shall receive, prior to being discharged from the
23   hospital, an eye examination using an opthalmoscope and dilation
24   of the pupils for detection of pediatric congenital and ocular
25   abnormalities.This section does not apply to cases where the
26   parents file with the physician, midwife, or other person in
27   attendance at the birth of a child written objections on account
28   of religious beliefs contrary to the use of drugs. In such case
29   the physician, midwife, or other person in attendance shall
30   maintain a record that such measures were or were not employed
31   and attach thereto any written objection.
32         Section 2. Section 383.07, Florida Statutes, is reenacted
33   to read:
34         383.07 Penalty for violation.--Any person who fails to
35   comply with the provisions of ss. 383.04-383.06 shall be guilty
36   of a misdemeanor of the second degree, punishable as provided in
37   s. 775.083.
38         Section 3. Paragraph (a) of subsection (2) of section
39   627.6416, Florida Statutes, is amended to read:
40         627.6416 Coverage for child health supervision services.--
41         (2) As used in this section, the term "child health
42   supervision services" means physician-delivered or physician-
43   supervised services that include, at a minimum, services
44   delivered at the intervals and scope stated in this section.
45         (a) Child health supervision services must include
46   periodic visits which shall include a history, a physical
47   examination, a developmental assessment and anticipatory
48   guidance,andappropriate immunizations and laboratory tests,
49   and eye examinations at birth, at 6 to 8 weeks of age, and at 6
50   to 9 months of age, using an opthalmoscope and dilation of the
51   pupils for detection of pediatric congenital and ocular
52   abnormalities and developmental abnormalities. Such services
53   and periodic visits shall be provided in accordance with
54   prevailing medical standards consistent with the Recommendations
55   for Preventive Pediatric Health Care of the American Academy of
56   Pediatrics.
57         Section 4. Paragraph (b) of subsection (30) of section
58   641.31, Florida Statutes, is amended to read:
59         641.31 Health maintenance contracts.--

61         (b) As used in this subsection, the term "child health
62   supervision services" means physician-delivered or physician-
63   supervised services that include, at a minimum, services
64   delivered at the intervals and scope stated in this subsection.
65         1. Child health supervision services must include periodic
66   visits which shall include a history, a physical examination, a
67   developmental assessment and anticipatory guidance,and
68   appropriate immunizations and laboratory tests, and eye
69   examinations at birth, at 6 to 8 weeks of age, and at 6 to 9
70   months of age, using an opthalmoscope and dilation of the pupils
71   for detection of pediatric congenital and ocular abnormalities
72   and developmental abnormalities. Such services and periodic
73   visits shall be provided in accordance with prevailing medical
74   standards consistent with the Recommendations for Preventive
75   Pediatric Health Care of the American Academy of Pediatrics.
76         2. Minimum benefits may be limited to one visit payable to
77   one provider for all of the services provided at each visit
78   cited in this subsection.
79         Section 5. This act shall take effect July 1, 2003.
