Be It Enacted by the Legislature of the State of Florida: |

Section 1. (1) The Entertainment Industry Financial |
11
|
Incentive Trust Fund is created within, and shall be |
12
|
administered by, the Office of Tourism, Trade, and Economic |
13
|
Development. Moneys credited to the fund shall be those |
14
|
appropriated from the General Revenue Fund or from other sources |
15
|
to make incentive payments under House Bill 1149 or similar |
16
|
legislation creating an entertainment industry financial |
17
|
incentive program. The purpose of the trust fund is to |
18
|
facilitate the payment of incentives under such program. |

|
(2) In accordance with s. 19(f)(2), Art. III of the State |
20
|
Constitution, the trust fund must, unless terminated sooner, be |
21
|
terminated on July 1, 2007. Before its scheduled termination, |
22
|
the trust fund must be reviewed as provided in s. 215.3206(1) |
23
|
and (2), Florida Statutes. |

Section 2. This act shall take effect on the effective |
25
|
date of House Bill 1149, or similar legislation, but it shall |
26
|
not take effect unless it is enacted by a three-fifths vote of |
27
|
the membership of each house of the Legislature and unless House |
28
|
Bill 1149, or similar legislation, becomes a law. |
