18 Section 1. Subsection (6) of section 261.03, Florida
19 Statutes, is amended and subsection (11) of said section is
20 added to read:
21 261.03 Definitions.--As used in this chapter, the
22 term:
23 (6) "Off-highway vehicle" means any ATV, two-rider
24 ATV, or OHM that is used off the roads or highways of this
25 state for recreational purposes and that is not registered and
26 licensed for highway use under chapter 320.
27 (11) "Two-rider ATV" means any ATV that is
28 specifically designed by the manufacturer for a single
29 operator and one passenger.
30 Section 2. Subsection (2) of section 316.2074, Florida
31 Statutes is amended to read:

1 316.2074 All-terrain vehicles.--
2 (2) As used in this section, the term "all-terrain
3 vehicle" means any motorized off-highway vehicle 50 inches or
4 less in width, having a dry weight of 900 pounds or less,
5 designed to travel on three or more low-pressure tires, having
6 a seat designed to be straddled by the operator and handlebars
7 for steering control, and intended for use by a single
8 operator with no passenger. For the purposes of this section,
9 "all-terrain vehicle" also includes any "two-rider ATV" as
10 defined in s. 317.0003.
11 Section 3. Subsection (6) of section 317.003, Florida
12 Statutes, is amended and subsection (9) of said section is
13 added to read:
14 317.0003 Definitions.--As used in ss.
15 317.0001-317.0013, the term:
16 (6) "Off-highway vehicle" means any ATV, two-rider
17 ATV, or OHM that is used off the roads or highways of this
18 state for recreational purposes and that is not registered and
19 licensed for highway use pursuant to chapter 320.
