14 On page 43, lines 5 and 6, delete those lines,
15
16 and insert:
17 Section 28. Subsection (9) of section 318.21, Florida
18 Statutes, is amended to read:
19 318.21 Disposition of civil penalties by county
20 courts.--All civil penalties received by a county court
21 pursuant to the provisions of this chapter shall be
22 distributed and paid monthly as follows:
23 (9) Twelve dollars and fifty cents from each moving
24 traffic violation must be used by the county to fund that
25 county's participation in an intergovernmental radio
26 communication program approved by the Department of Management
27 Services. If the county is not participating in such a
28 program, funds collected must be used to fund local law
29 enforcement automation or law enforcement communications and
30 must be distributed to the municipality or special improvement
31 district in which the violation occurred or to the county if

1 the violation occurred within the unincorporated area of the
2 county. If a municipality within the county maintains an
3 independent 800 megahertz radio communication program that can
4 achieve interoperable communication with the county's system,
5 funds collected from violations that occur within the
6 territorial jurisdiction of that municipality must be used to
7 fund local law enforcement automation or law enforcement
8 communications and must be distributed to that municipality.
9 Section 29. This act shall take effect October 1,
10 2003, but shall not apply to any interlocal agreement between
11 a municipality and a county concerning these funds which is in
12 effect on March 4, 2003.
