(5)(a) As used in this subsection, the term:
|
|
17
|
1. “Pretrial release service” means any government-funded |
|
18
|
program whose functions include making recommendations to any |
|
19
|
court regarding the pretrial release of any defendant from |
|
20
|
custody.
|
|
21
|
2. “Annual report” means a report prepared by a pretrial |
|
22
|
release service that accurately and objectively reports the |
|
23
|
performance of such service with the use of taxpayer monies.
|
|
24
|
(b) The pretrial release service in any county of the |
|
25
|
state shall maintain data compiled on a monthly basis regarding |
|
26
|
the cases and defendants who are processed for release by such |
|
27
|
service. The data to be maintained shall display accurate, |
|
28
|
objective information for each defendant, including, but not |
|
29
|
limited to:
|
|
30
|
1. The charges against each defendant.
|
|
31
|
2. The nature of any prior arrest against each defendant.
|
|
32
|
3. The court appearances required for each defendant.
|
|
33
|
4. Each court appearance at which the defendant failed to |
|
34
|
appear.
|
|
35
|
5. Each capias issued, as well as each time a capias was |
|
36
|
not issued when the defendant failed to appear.
|
|
37
|
6. The recommendation of the pretrial release service |
|
38
|
relative to each defendant.
|
|

|
(c) By December 1 of each year, the pretrial release |
|
40
|
service shall submit an annual report to the chair of the |
|
41
|
governing authority of the county, the Governor, the Speaker of |
|
42
|
the House of Representatives, and the President of the Senate.
|
|
43
|
(d) The annual report shall be submitted in a format |
|
44
|
approved by the Executive Office of the Governor, in |
|
45
|
consultation with the Office of the State Courts Administrator. |
|
46
|
The annual report shall include, but not be limited to:
|
|
47
|
1. The operating budget of the pretrial release service.
|
|
48
|
2. The number of personnel employed by or contracted with |
|
49
|
the pretrial release service.
|
|
50
|
3. The number and disposition of all cases reviewed by the |
|
51
|
pretrial release service.
|
|
52
|
4. The number of cases, categorized as either felony or |
|
53
|
misdemeanor, where the defendant was released with a financial |
|
54
|
condition.
|
|
55
|
5. The number of cases, categorized as either felony or |
|
56
|
misdemeanor, where the defendant was released without financial |
|
57
|
conditions.
|
|
58
|
(e) No additional public funds shall be expended for the |
|
59
|
preparation and production of the annual report. |
