2	An act relating to determination of resident status for
3	tuition purposes; amending s. 1009.21, F.S.; classifying
4	specified students as residents for tuition purposes;
5	providing an effective date.

7	Be It Enacted by the Legislature of the State of Florida:

9	Section 1. Paragraph (k) is added to subsection (10) of
10	section 1009.21, Florida Statutes, to read:
11	1009.21 Determination of resident status for tuition
12	purposes.--Students shall be classified as residents or
13	nonresidents for the purpose of assessing tuition in community
14	colleges and state universities.
15	(10) The following persons shall be classified as
16	residents for tuition purposes:
17	(k) Students who meet the following requirements:
18	1. Have resided in Florida for at least 3 consecutive
19	years immediately preceding the date the student received a high
20	school diploma or its equivalent and have attended a Florida
21	high school for at least 3 consecutive school years during such
22	time.
23	2. Have provided to a community college or a state
24	university an affidavit stating that the student will file an
25	application to become a permanent resident of the United States
26	at the earliest opportunity he or she is eligible to do so.
27	Section 2. This act shall take effect July 1, 2003.
