14 On page 33, line 27, through
15 page 75, line 24, delete those lines

17 and insert:
18 Section 9. Paragraph (a) of subsection (11) of section
19 627.736, Florida Statutes, is amended to read:
20 627.736 Required personal injury protection benefits;
21 exclusions; priority; claims.--
22 (11) DEMAND LETTER.--
23 (a) As a condition precedent to filing any action for
24 an overdue claim for benefits under paragraph (4)(b), the
25 insurer must be provided with written notice of an intent to
26 initiate litigation; provided, however, that, except with
27 regard to a claim or amended claim or judgment for interest
28 only which was not paid or was incorrectly calculated, such
29 notice is not required for an overdue claim that the insurer
30 has denied or reduced, nor is such notice required if the
31 insurer has been provided documentation or information at the

1 insurer's request pursuant to subsection (6). Such notice may
2 not be sent until the claim is overdue, including any
3 additional time the insurer has to pay the claim pursuant to
4 paragraph (4)(b).
