11  Senator Alexander moved the following amendment:

13         Senate Amendment 
14         On page 94, line 9, through
15            page 95, line 14,  delete those lines
16  
17  and insert:  
18         Section 16.  The amendment made by this act to section
19  456.0375(1)(b), Florida Statutes, is intended to clarify the
20  legislative intent of this provision as it existed at the time
21  the provision initially took effect. Accordingly, section
22  456.0375(1)(b), Florida Statutes, as amended by this act shall
23  operate retroactively to October 1, 2001.
24         Section 17.  Effective March 1, 2004, section 456.0375,
25  Florida Statutes, is repealed.
26         Section 18.  (1)  On or before January 1, 2004, every
27  insurer writing with a managing general agent and having a
28  per-policy fee in its rate filing shall make a rate filing
29  under section 627.062 or section 627.0651, Florida Statutes,
30  to conform its per-policy fee to the requirements of this act.
31         (2)  Any increase in benefits approved by the Financial

 1  Services Commission under subsection (12) of section 627.736,
 2  Florida Statutes, as added by this act, shall apply to new and
 3  renewal policies that are effective 120 days after the order
 4  issued by the commission becomes final. Subsection (2) of
 5  section 627.739, Florida Statutes, as amended by this act,
 6  shall apply to new and renewal policies issued on or after
 7  October 1, 2003.
 8         (3)  Subsection (11) of section 627.736, Florida
 9  Statutes, as amended by this act, shall apply to actions filed
10  on and after the effective date of this act.
11         (4)  Paragraph (7)(a) of section 627.736, Florida
