12 following amendment to amendment (154890):

15 On page 8, line 20, through
16 page 9, line 31, delete those lines
17
18 and insert: percent of the allowable amount under the
19 participating physician fee schedule of Medicare Part B for
20 year 2001, for the area in which the treatment was rendered,
21 adjusted annually on July 1 to reflect the prior calendar
22 year's changes in the annual Medical Care Item of the Consumer
23 Price Index for All Urban Consumers in the South Region as
24 determined by the Bureau of Labor Statistics of the United
25 States Department of Labor by an additional amount equal to
26 the medical Consumer Price Index for Florida.
27 4. Allowable amounts that may be charged to a personal
28 injury protection insurance insurer and insured for medically
29 necessary nerve conduction testing that does not meet the
30 requirements of subparagraph 3. shall not exceed the
31 applicable fee schedule or other payment methodology

1 established pursuant to s. 440.13.
2 5. Effective upon this act becoming a law and before
3 November 1, 2001, allowable amounts that may be charged to a
4 personal injury protection insurance insurer and insured for
5 magnetic resonance imaging services shall not exceed 200
6 percent of the allowable amount under Medicare Part B for year
7 2001, for the area in which the treatment was rendered.
8 Beginning November 1, 2001, allowable amounts that may be
9 charged to a personal injury protection insurance insurer and
10 insured for magnetic resonance imaging services shall not
11 exceed 175 percent of the allowable amount under the
12 participating physician fee schedule of Medicare Part B for
13 year 2001, for the area in which the treatment was rendered,
14 adjusted annually on July 1 to reflect the prior calendar
15 year's changes in the annual Medical Care Item of the Consumer
16 Price Index for All Urban Consumers in the South Region as
17 determined by the Bureau of Labor Statistics of the United
18 States Department of Labor by an additional amount equal to
19 the medical Consumer Price Index for Florida, except that
20 allowable amounts that may be charged to a personal injury
21 protection insurance insurer and insured for magnetic
22 resonance imaging services provided in facilities accredited
23 by the American College of Radiology or the Joint Commission
24 on Accreditation of Healthcare Organizations shall not exceed
25 200 percent of the allowable amount under the participating
26 physician fee schedule of Medicare Part B for year 2001, for
27 the area in which the treatment was rendered, adjusted
28 annually on July 1 to reflect the prior calendar year's
29 changes in the annual Medical Care Item of the Consumer Price
30 Index for All Urban Consumers in the South Region as
31 determined by the Bureau of Labor Statistics of the United
