14 On page 31, line 17, through page 33, line 26, delete
15 those lines,

17 and insert:
18 (9) "Immediate personal supervision," as it relates to
19 the performance of medical services by nonphysicians not in a
20 hospital, means that an individual licensed to perform the
21 medical service or provide the medical supplies must be
22 present within the confines of the physical structure where
23 the medical services are performed or where the medical
24 supplies are provided such that the licensed individual can
25 respond immediately to any emergencies if needed.
26 (10) "Incident," with respect to services considered
27 as incident to a physician's professional service, for a
28 physician licensed under chapter 458, chapter 459, chapter
29 460, or chapter 461, if not furnished in a hospital, means
30 such services must be an integral, even if incidental, part of
31 a covered physician's service.

1 (11) "Knowingly" means that a person, with respect to
2 information, has actual knowledge of the information; acts in
3 deliberate ignorance of the truth or falsity of the
4 information; or acts in reckless disregard of the information,
5 and proof of specific intent to defraud is not required.
6 (12) "Lawful" or "lawfully" means in substantial
7 compliance with all relevant applicable criminal, civil, and
8 administrative requirements of state and federal law related
9 to the provision of medical services or treatment.
10 (13) "Hospital" means a facility that, at the time
11 services or treatment were rendered, was licensed under
12 chapter 395.
13 (14) "Properly completed" means providing truthful,
14 substantially complete, and substantially accurate responses
15 as to all material elements to each applicable request for
16 information or statement by a means that may lawfully be
17 provided and that complies with this section, or as agreed by
18 the parties.
19 (15) "Upcoding" means an action that submits a billing
20 code that would result in payment greater in amount than would
21 be paid using a billing code that accurately describes the
22 services performed. The term does not include an otherwise
23 lawful bill by a magnetic resonance imaging facility, which
24 globally combines both technical and professional components
25 for services listed in that definition, if the amount of the
26 global bill is not more than the components if billed
27 separately; however, payment of such a bill constitutes
28 payment in full for all components of such service.
29 (16) "Unbundling" means an action that submits a
30 billing code that is properly billed under one billing code,
31 but that has been separated into two or more billing codes,
