19 (10)(a) An insurer may negotiate and enter into
20 contracts with licensed health care providers for the benefits
21 described in this section, referred to in this section as
22 "preferred providers," which shall include health care
23 providers licensed under chapters 458, 459, 460, 461, and 463.
24 The insurer may provide an option to an insured to use a
25 preferred provider at the time of purchase of the policy for
26 personal injury protection benefits, if the requirements of
27 this subsection are met. If the insured elects to use a
28 provider who is not a preferred provider, whether the insured
29 purchased a preferred provider policy or a nonpreferred
30 provider policy, the medical benefits provided by the insurer
31 shall be as required by this section. If the insured elects to

1 use a provider who is a preferred provider, the insurer may
2 pay medical benefits in excess of the benefits required by
3 this section and may waive or lower the amount of any
4 deductible that applies to such medical benefits. If the
5 insurer offers a preferred provider policy to a policyholder
6 or applicant, it must also offer a nonpreferred provider
7 policy. The insurer shall provide each policyholder with a
8 current roster of preferred providers in the county in which
9 the insured resides at the time of purchase of such policy,
10 and shall make such list available for public inspection
11 during regular business hours at the principal office of the
12 insurer within the state.
13 (b) Paragraph (a) does not prohibit an insurer that
14 chooses not to offer a preferred provider policy from
15 providing the benefits described in subsection (1) pursuant to
16 a contract entered into directly with a licensed health care
17 provider or hospital that establishes agreed amounts to be
18 charged by such health care provider or hospital for services
19 rendered to persons entitled to such benefits. Such agreement
20 shall establish the reasonable amount for such services in
21 accord with subsection (1).
