An act relating to Department of Corrections career |

service; amending s. 110.205, F.S.; deleting obsolete |

language; classifying colonels and majors within the |

department as Selected Exempt Service employees; providing |

an effective date. |

Be It Enacted by the Legislature of the State of Florida: |
9
|
|

|
Section 1. Paragraphs (d) and (m) of subsection (2) of |
11
|
section 110.205, Florida Statutes, are amended to read: |
12
|
110.205 Career service; exemptions.-- |
13
|
(2) EXEMPT POSITIONS.--The exempt positions that are not |
14
|
covered by this part include the following: |
15
|
(d) All officers and employees of the state universities |
16
|
and the Correctional Education Program within the Department of |
17
|
Corrections,and the academic personnel and academic |
18
|
administrative personnel of the Florida School for the Deaf and |
19
|
the Blind. In accordance with the provisions of s. 1002.36, the |
20
|
salaries for academic personnel and academic administrative |
21
|
personnel of the Florida School for the Deaf and the Blind shall |
22
|
be set by the board of trustees for the school, subject only to |
23
|
the approval of the State Board of Education. The salaries for |
24
|
all instructional personnel and all administrative and |
25
|
noninstructional personnel of the Correctional Education Program |
26
|
shall be set by the Department of Corrections, subject to the |
27
|
approval of the Department of Management Services. |

|
(m) All assistant division director, deputy division |
29
|
director, and bureau chief positions in any department, and |
30
|
those positions determined by the department to have managerial |
31
|
responsibilities comparable to such positions, which positions |
32
|
include, but are not limited to, positions in the Department of |
33
|
Health, the Department of Children and Family Services, and the |
34
|
Department of Corrections that are assigned primary duties of |
35
|
serving as the superintendent or assistant superintendent, or |
36
|
warden,or assistant warden, colonel, or majorof an |
37
|
institution; positions in the Department of Corrections that are |
38
|
assigned primary duties of serving as the circuit administrator |
39
|
or deputy circuit administrator; positions in the Department of |
40
|
Transportation that are assigned primary duties of serving as |
41
|
regional toll managers and managers of offices as defined in s. |
42
|
20.23(3)(d)3. and (4)(d); positions in the Department of |
43
|
Environmental Protection that are assigned the duty of an |
44
|
Environmental Administrator or program administrator; and |
45
|
positions in the Department of Health that are assigned the |
46
|
duties of Environmental Administrator, Assistant County Health |
47
|
Department Director, and County Health Department Financial |
48
|
Administrator. Unless otherwise fixed by law, the department |
49
|
shall set the salary and benefits of these positions in |
50
|
accordance with the rules established for the Selected Exempt |
51
|
Service. |

Section 2. This act shall take effect July 1, 2003. |
