amending s. 110.205, F.S.; deleting from career service |

exemption provisions obsolete language relating to the |

Correctional Education Program; classifying colonels and |

majors within the Department of Corrections as Selected |
|
7
|
Exempt Service employees; providing an effective date. |
|

Be It Enacted by the Legislature of the State of Florida: |
|
10
|
|
|
11
|
Section 1. Paragraphs (d) and (m) of subsection (2) of |
|
12
|
section 110.205, Florida Statutes, are amended to read: |
|
13
|
110.205 Career service; exemptions.-- |
|
14
|
(2) EXEMPT POSITIONS.--The exempt positions that are not |
|
15
|
covered by this part include the following: |
|
16
|
(d) All officers and employees of the state universities |
|
17
|
and the Correctional Education Program within the Department of |
|
18
|
Corrections,and the academic personnel and academic |
|
19
|
administrative personnel of the Florida School for the Deaf and |
|
20
|
the Blind. In accordance with the provisions of s. 1002.36, the |
|
21
|
salaries for academic personnel and academic administrative |
|
22
|
personnel of the Florida School for the Deaf and the Blind shall |
|
23
|
be set by the board of trustees for the school, subject only to |
|
24
|
the approval of the State Board of Education. The salaries for |
|
25
|
all instructional personnel and all administrative and |
|
26
|
noninstructional personnel of the Correctional Education Program |
|
27
|
shall be set by the Department of Corrections, subject to the |
|
28
|
approval of the Department of Management Services. |
|
29
|
(m) All assistant division director, deputy division |
|
30
|
director, and bureau chief positions in any department, and |
|
31
|
those positions determined by the department to have managerial |
|
32
|
responsibilities comparable to such positions, which positions |
|
33
|
include, but are not limited to:, |
|
34
|
1. Positions in the Department of Health and,the |
|
35
|
Department of Children and Family Services, and the Department |
|
36
|
of Correctionsthat are assigned primary duties of serving as |
|
37
|
the superintendent or assistant superintendent of an |
|
38
|
institution., or
|
|
39
|
2. Positions in the Department of Corrections that are |
|
40
|
assigned primary duties of serving as the warden,orassistant |
|
41
|
warden, colonel, or major of an institution or; positions in the |
|
42
|
Department of Correctionsthat are assigned primary duties of |
|
43
|
serving as the circuit administrator or deputy circuit |
|
44
|
administrator.; |
|

|
3.Positions in the Department of Transportation that are |
|
46
|
assigned primary duties of serving as regional toll managers and |
|
47
|
managers of offices as defined in s. 20.23(3)(d)3. and (4)(d).; |
|
48
|
4.Positions in the Department of Environmental Protection |
|
49
|
that are assigned the duty of an Environmental Administrator or |
|
50
|
program administrator.; and |
|
51
|
5.Positions in the Department of Health that are assigned |
|
52
|
the duties of Environmental Administrator, Assistant County |
|
53
|
Health Department Director, and County Health Department |
|
54
|
Financial Administrator. |
|

|

|
Unless otherwise fixed by law, the department shall set the |
|
57
|
salary and benefits of thethese positions listed in this |
|
58
|
paragraphin accordance with the rules established for the |
|
59
|
Selected Exempt Service. |
|

|
Section 2. This act shall take effect July 1, 2003. |
