  1                      A bill to be entitled

  2         An act relating to bankruptcy; prohibiting the

  3         sale or disclosure of personal customer

  4         information by persons in bankruptcy; providing

  5         an effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  (1)  A person who files for bankruptcy may

10  not sell or otherwise transfer to another any database that

11  contains personal customer information if the bankrupt person,

12  through contract or a published privacy policy, agreed or

13  stated that personal customer information would not be

14  disclosed.

15         (2)  A person whose personal customer information is

16  disclosed in violation of this act may file an action for

17  damages against the person who disclosed such information.

18         Section 2.  This act shall take effect July 1, 2003.
