6 issues; providing membership; requiring
7 reporting of findings and recommendations;
8 providing for review of certain data; providing
9 appropriations; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:
12
13 Section 1. Section 500.033, Florida Statutes, is
14 created to read:
15 500.033 Florida Food Safety and Food Security Advisory
16 Council.--
17 (1) There is created the Florida Food Safety and Food
18 Security Advisory Council for the purpose of serving as a
19 forum for presenting, investigating, and evaluating issues of
20 current importance to the assurance of a safe and secure food
21 supply to the citizens of Florida. The Florida Food Safety and
22 Food Security Advisory Council shall consist of, but not be
23 limited to: the Commissioner of Agriculture or his or her
24 designee; the Secretary of Health or his or her designee; the
25 Secretary of Business and Professional Regulation or his or
26 her designee; the person responsible for domestic security
27 with the Florida Department of Law Enforcement; members
28 representing the production, processing, distribution, and
29 sale of foods; consumers and/or members of citizens groups or
30 food industry groups; scientists or other experts in aspects
31 of food safety from state universities; representatives from

1 local, state, and federal agencies that are charged with
2 responsibilities for food safety or food security; the chairs
3 of the Agriculture Committees of the Senate and the House of
4 Representatives or their designees; and the chairs of the
5 committees of the Senate and the House of Representatives with
6 jurisdictional oversight of home defense issues or their
7 designees. The Commissioner of Agriculture shall appoint the
8 remaining members. The council shall make periodic reports to
9 the Department of Agriculture and Consumer Services concerning
10 findings and recommendations in the area of food safety and
11 food security.
12 (2) The council shall consider the development of
13 appropriate advice or recommendations on food safety or food
14 security issues. In the discharge of their duties, the council
15 members may receive for review confidential data exempt from
16 the provisions of s. 119.07(1); however, it is unlawful for
17 any member of the council to use the data for his or her
18 advantage or reveal the data to the general public.
19 Section 2. There is hereby provided a continuing
20 appropriation in the expenses category the sum of $5,000 from
21 the Contract and Grants Trust Fund within the Department of
22 Agriculture and Consumer Services and the sum of $5,000 from
23 the General Inspection Trust Fund within the Department of
24 Agriculture and Consumer Services for use in payment of
25 associated costs in the conduct of activities of the Florida
26 Food Safety and Food Security Advisory Council.
27 Section 3. This act shall take effect July 1, 2003.

1 STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
COMMITTEE SUBSTITUTE FOR

4 Committee Substitute for SB 1218 is different from Senate Bill
1218 in that it:

1. Changes the name of the Food Safety Advisory Council to
6 the Florida Food Safety and Food Security Advisory
Council;
7
2. Expands the membership of the council; and
8
3. Authorizes the council members to receive confidential
9 data for review; however, it is unlawful for any member
of the council to use the data for his or her advantage
10 or to reveal the data to the general public.
