concurrent resolution by the Legislature of the salaries |

of certain state employees; defining the term “salary”; |

providing for temporary approval of such salaries by the |
7
|
Legislative Budget Commission; providing exceptions; |
8
|
providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

|
Section 1. Section 110.1081, Florida Statutes, is created |
13
|
to read: |

|
110.1081 Legislative approval for salaries of state |
15
|
employees above a certain range.--
|

|
(1) Except as provided herein, no state employee may be |
17
|
approved for an annual salary above $200,000 without approval of |
18
|
the Florida Legislature. For the purpose of this section, |
19
|
“salary” is defined as wages and all non-health-care benefits, |
20
|
including, but not limited to, housing allowances, personal |
21
|
vehicle allowances, and spouse travel allowances. For all salary |
22
|
requests above $200,000, agency heads shall petition in writing |
23
|
the President of the Senate and the Speaker of the House of |
24
|
Representatives and shall provide a copy of such petition to the |
25
|
minority leader of each house. The petition should provide |
26
|
documentation demonstrating the reasons for the high salary, |
27
|
including, but not limited to, market factors, employment |
28
|
history, and prior salaries. The Legislature may approve the |
29
|
salary by concurrent resolution.

(2) During times that the Legislature is not within 30 |
31
|
days of convening in regular session, the President of the |
32
|
Senate and the Speaker of the House of Representatives may |
33
|
forward the petition to the Legislative Budget Commission for |
34
|
its consideration. If approved, such approval shall only be for |
35
|
the remainder of the fiscal year in which approved and if not |
36
|
approved by the entire Legislature at its next regular session, |
37
|
the employment shall be terminated or the annual salary reduced |
38
|
to $200,000.

(3) This section shall not apply to the salaries of |
40
|
medical professionals teaching at state universities.

Section 2. This act shall take effect July 1, 2003. |
