    Florida Senate - 2003 SB 126

reviewed and saved from repeal through reenactment by the

 Legislature.

Section 2. The Legislature finds that it is a public

necessity that photographs, videotapes, and other digital or

recorded images of any part of the body of a victim of a

sexual offense be made confidential and exempt from the

requirements of section 119.07(1), Florida Statutes, and

Section 24(a) of Article I of the State Constitution. The

Legislature finds that such photographs or images often depict

the victim in a graphic and disturbing fashion, and that such

photographs or images, if viewed, copied, or publicized, could

result in trauma, humiliation, or emotional injury to the

victim and the family of the victim. Accordingly, the

Legislature finds that the harm to the public which would

result from the release of such photographs, videotapes, or

other digital or recorded images substantially outweighs any

 minimal public benefit derived therefrom.

Section 3. This act shall take effect upon becoming a

 law.
