1 A bill to be entitled
2          An act relating to public school performance-based
3    funding; providing funding to school districts based on
4    performance or improvement as measured by the FCAT;
5    providing for calculation of awards; providing for use of
6    funds; providing appropriations; providing an effective
7    date.

9          Be It Enacted by the Legislature of the State of Florida:
10         
11          Section 1. Performance-based FCAT funding.--As of July 1,
12    2003, results are reported for each of the FCAT tests for
13    reading and mathematics at each grade level 3 through 10. For
14    purposes of this section, this results in a total of 16
15    categories in which school districts may receive performance
16    and/or improvement funds based on the achievement of their
17    students in the testing categories of the FCAT.
18          (1) School districts shall be recognized for their
19    accomplishment in attaining the highest performance scores, as
20    determined by mean scale score, in each of the 16 FCAT
21    categories. Upon ranking all the school districts in the state
22    to reflect the highest performance in each of the 16 categories
23    of the FCAT, the top 10 school districts in each category shall
24    be allocated an amount of money based on the outstanding
25    performance of their students. The calculation for individual
26    school district awards shall be calculated pursuant to
27    subsection (3).
28          (2) School districts shall be recognized for their
29    accomplishment in gaining the highest improvement in performance
30    scores, as determined by mean scale score, in each of the 16
31    FCAT categories. Upon ranking all the school districts in the
32    state to reflect the highest improvement in each of the 16
33    categories of FCAT testing, the top 10 school districts in each
34    category shall be allocated an amount of money based on the
35    outstanding improvement of their students. The calculation for
36    individual school district awards shall be calculated pursuant
37    to subsection (3).
38          (3) Total unweighted FTE shall be used as the basis for
39    purposes of calculating the awards for each qualifying school
40    district. For each of subsections (1) and (2), the number of
41    FTE from the previous year shall be determined for the top 10
42    school districts in each of the 16 categories. The calculation
43    of a dollar amount per FTE shall be performed to determine a
44    share value of each FTE and specific allocation for each school
45    district. The calculation shall be as follows: the school
46    district placing tenth in a category shall receive one share per
47    FTE; the school district placing ninth in a category shall
48    receive two shares per FTE; the school district placing eighth
49    in a category shall receive three shares per FTE; the school
50    district placing seventh in a category shall receive four shares
51    per FTE; the school district placing sixth in a category shall
52    receive five shares per FTE; the school district placing fifth
53    in a category shall receive six shares per FTE; the school
54    district placing fourth in a category shall receive seven shares
55    per FTE; the school district placing third in a category shall
56    receive eight shares per FTE; the school district placing second
57    in a category shall receive nine shares per FTE; and the school
58    district placing first in a category shall receive ten shares
59    per FTE. Once the total number of FTE shares required for each
60    of the two performance-based incentives pursuant to subsections
61    (1) and (2) is determined, that number shall be divided into the
62    respective appropriation to determine a dollar value per FTE
63    share for each of the two performance-based incentives. The
64    calculation of the dollar value per FTE share for subsections
65    (1) and (2) shall be performed independently of one another.
66    The two per FTE dollar values shall be used in calculating the
67    awards for each of the 16 categories for subsections (1) and
68    (2). Final allocations from the Department of Education to
69    school districts shall be determined by totaling award dollars
70    from both performance-based incentives by school district.
71          (4) Performance or improvement funds earned pursuant to
72    this section shall be utilized in support of supplemental
73    academic instruction programs.
74          (5) Nothing in this section shall preclude school
75    districts from earning additional dollars for enhancement,
76    performance, or improvement as provided elsewhere by law.
77          Section 2. There is hereby appropriated from the General
78    Revenue Fund to the Department of Education for fiscal year
79    2003-2004 the sum of $25 million to implement the provisions of
80    subsection (1) of section 1 of this act and $25 million to
81    implement the provisions of subsection (2) of section 1 of this
82    act.
83          Section 3. This act shall take effect July 1, 2003.
