| 2 | An act relating to a surcharge for trauma center funding; | ||
| 3 | creating s. 316.19305, F.S.; imposing a surcharge on | ||
| 4 | persons convicted of driving under the influence to | ||
| 5 | provide funding for level II trauma centers; providing for | ||
| 6 | remittance, deposit, and distribution of the proceeds of | ||
| 7 | the surcharge; providing an effective date. | ||

| 9 | Be It Enacted by the Legislature of the State of Florida: | ||
| 10 | |||
| 11 | Section 1. Section 316.19305, Florida Statutes, is created | ||
| 12 | to read: | ||
| 13 | 316.19305 Driving under the influence; surcharge for | ||
| 14 | trauma center funding.--In addition to the penalties specified | ||
| 15 | in s. 316.193, there is imposed on any person convicted of | ||
| 16 | driving under the influence in violation of s. 316.193 a | ||
| 17 | surcharge of $5 for each conviction. Notwithstanding ss. 316.660 | ||
| 18 | and 318.21, the proceeds of the surcharge imposed under this | ||
| 19 | section shall be remitted to the Department of Revenue for | ||
| 20 | deposit in the Trauma Services Trust Fund, to be used solely for | ||
| 21 | the purpose of providing funding for level II trauma centers. | ||
| 22 | Funds shall be distributed equally on a monthly basis to all | ||
| 23 | state-approved or provisional state-approved level II trauma | ||
| 24 | centers operating in the state. | ||
| 25 | Section 2. This act shall take effect July 1, 2003. | ||
