12          An act relating to criminal offenses; providing a popular
13    name; amending s. 812.0145, F.S.; providing for a
14    mandatory term of imprisonment for certain thefts against
15    persons 65 years of age or older; changing the dollar
16    values which constitute differing levels of the offense;
17    amending s. 825.103, F.S.; providing for a mandatory term
18    of imprisonment for certain acts of exploitation against
19    an elderly person or disabled adult; changing the dollar
20    values which constitute differing levels of the offense;
21    amending s. 921.0022, F.S.; ranking such offenses on the
22    offense severity ranking chart of the Criminal Punishment
23    Code; providing an effective date.
24         
25          Be It Enacted by the Legislature of the State of Florida:
26         
27          Section 1. This act shall be known by the popular name
28    "The Seniors' Safety Act of 2003."
29          Section 2. Section 812.0145, Florida Statutes, is amended
30    to read:
31          812.0145 Theft from persons 65 years of age or older;
32    reclassification of offenses.--
33          (1) A person who is convicted of theft of more than $1,000
34    from a person 65 years of age or older shall be ordered by the
35    sentencing judge to make restitution to the victim of such
36    offense and to perform up to 500 hours of community service
37    work. Restitution and community service work shall be in
38    addition to any fine or sentence which may be imposed and shall
39    not be in lieu thereof.
40          (2) Whenever a person is charged with committing theft
41    from a person 65 years of age or older, when he or she knows or
42    has reason to believe that the victim was 65 years of age or
43    older,the offense for which the person is charged shall be
44    reclassified as follows:
45          (a) If the funds, assets, or property involved in the
46    theft from a person 65 years of age or older is valued at
47    $50,000 or more, the offender commits a felony of the first
48    degree, punishable as provided in s. 775.082, s. 775.083, or s.
49    775.084. Notwithstanding any other provision of law, a person
50    who is convicted of the offense prohibited by this paragraph
51    shall be sentenced to a minimum term of imprisonment of 3 years.
52          (b) If the funds, assets, or property involved in the
53    theft from a person 65 years of age or older is valued at $1,000
54    $10,000or more, but less than $50,000, the offender commits a
55    felony of the second degree, punishable as provided in s.
56    775.082, s. 775.083, or s. 775.084. Notwithstanding any other
57    provision of law, a person who is convicted of the offense
58    prohibited by this paragraph shall be sentenced to a minimum
59    term of imprisonment of 3 years.
60          (c) If the funds, assets, or property involved in the
61    theft from a person 65 years of age or older is valued at $300
62    or more, but less than $1,000$10,000, the offender commits a
63    felony of the third degree, punishable as provided in s.
64    775.082, s. 775.083, or s. 775.084.
65          Section 3. Section 825.103, Florida Statutes, is amended
66    to read:
67          825.103 Exploitation of an elderly person or disabled
68    adult; penalties.--
69          (1) "Exploitation of an elderly person or disabled adult"
70    means:
71          (a) Knowingly, by deception or intimidation, obtaining or
72    using, or endeavoring to obtain or use, an elderly person's or
73    disabled adult's funds, assets, or property with the intent to
74    temporarily or permanently deprive the elderly person or
75    disabled adult of the use, benefit, or possession of the funds,
76    assets, or property, or to benefit someone other than the
77    elderly person or disabled adult, by a person who:
78          1. Stands in a position of trust and confidence with the
79    elderly person or disabled adult; or
80          2. Has a business relationship with the elderly person or
81    disabled adult; or
82          (b) Obtaining or using, endeavoring to obtain or use, or
83    conspiring with another to obtain or use an elderly person's or
84    disabled adult's funds, assets, or property with the intent to
85    temporarily or permanently deprive the elderly person or
86    disabled adult of the use, benefit, or possession of the funds,
87    assets, or property, or to benefit someone other than the
88    elderly person or disabled adult, by a person who knows or
89    reasonably should know that the elderly person or disabled adult
90    lacks the capacity to consent.
91          (2)(a) If the funds, assets, or property involved in the
92    exploitation of the elderly person or disabled adult is valued
93    at $100,000 or more, the offender commits a felony of the first
94    degree, punishable as provided in s. 775.082, s. 775.083, or s.
95    775.084. Notwithstanding any other provision of law, a person
96    who is convicted of the offense prohibited by this paragraph
97    shall be sentenced to a minimum term of imprisonment of 5 years.
98          (b) If the funds, assets, or property involved in the
99    exploitation of the elderly person or disabled adult is valued
100    at $1,000$20,000or more, but less than $100,000, the offender
101    commits a felony of the second degree, punishable as provided in
102    s. 775.082, s. 775.083, or s. 775.084. Notwithstanding any other
103    provision of law, a person who is convicted of the offense
104    prohibited by this paragraph shall be sentenced to a minimum
105    term of imprisonment of 3 years.
106          (c) If the funds, assets, or property involved in the
107    exploitation of an elderly person or disabled adult is valued at
108    less than $1,000$20,000, the offender commits a felony of the
109    third degree, punishable as provided in s. 775.082, s. 775.083,
110    or s. 775.084.
111          Section 4. Paragraphs (c), (e), (f), and (g) of subsection
112    (3) of section 921.0022, Florida Statutes, are amended to read:
