18	Section 6. Subsection (3) is added to section 378.207,
19	Florida Statutes, to read:
20	378.207 Reclamation criteria and standards.--
21	(3) To minimize the impacts of phosphate mining on the
22	waters and uplands in the most sensitive areas around the
23	headwaters of Charlotte Harbor and to reduce the risks that
24	Charlotte Harbor and its tributaries are affected by spills from
25	phosphate mining clay settling ponds, there shall be a buffer
26	wherein no mining activity shall take place within the 100 year
27	floodplain of the Peace River, Horse Creek, the Myakka River and
28	each of their tributaries, south of the northernmost boundary of
29	Township 35 South, Ranges 22, 23, 24, 25, 26 East of Latitude
30	North 27 Degrees 28 minutes. In no instance, however, shall the
31	buffer be less than a distance of 1000 feet from the mean high
32	waterline nor greater than 1750 feet from the mean high
33	waterline of the Peace River, Horse Creek, Myakka River and each
34	of their tributaries. Where this section prohibits the
35	exploitation of otherwise commercially viable phosphate
36	deposits, and phosphate mining rights in the prohibited area are
37	owned by an entity seeking approval for phosphate mining in an
38	area contiguous with the prohibited area, the department may
39	consider the prohibited area as preserved land when reviewing
40	mine reclamation plans under this 378 and when it is otherwise
41	appropriate under applicable statutes and rules.
