An act relating to disposition of civil penalties; |

amending s. 318.21, F.S.; requiring use of civil penalties |

to fund local law enforcement automation under certain |

|
circumstances; providing an effective date. |

Be It Enacted by the Legislature of the State of Florida: |

|
|

|
Section 1. Subsection (9) of section 318.21, Florida |
10
|
Statutes, is amended to read: |

|
318.21 Disposition of civil penalties by county courts.-- |
12
|
All civil penalties received by a county court pursuant to the |
13
|
provisions of this chapter shall be distributed and paid monthly |
14
|
as follows: |

|
(9) Twelve dollars and fifty cents from each moving |
16
|
traffic violation must be used by the county to fund that |
17
|
county's participation in an intergovernmental radio |
18
|
communication program approved by the Department of Management |
19
|
Services. If the county is not participating in such a program, |
20
|
funds collected must be used to fund local law enforcement |
21
|
automation and must be distributed to the municipality or |
22
|
special improvement district in which the violation occurred or |
23
|
to the county if the violation occurred within the |
24
|
unincorporated area of the county. If a municipality within the |
25
|
county maintains an independent 800-megahertz radio |
26
|
communication program that can communicate with the county's |
27
|
system or if the mutual aid channels are compatible, funds |
28
|
collected from violations that occur within the territorial |
29
|
jurisdiction of that municipality must be used to fund local law |
30
|
enforcement automation and must be distributed to that |
31
|
municipality. |

Section 2. This act shall take effect upon becoming a law. |
