  1                      A bill to be entitled

  2         An act relating to the South Trail Fire

  3         Protection and Rescue District, Lee County;

  4         amending ch. 2000-484, Laws of Florida;

  5         conforming the district charter to Florida

  6         Statutes relating to annexations within the

  7         district; providing an effective date.

  8

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Section 5 of section 3 of chapter 2000-484,

12  Laws of Florida, is amended to read:

13         Section 5.  Section 171.093, Florida Statutes, as it

14  may be amended from time to time, is applicable to any

15  annexation of land located within the District's boundaries.

16  Beginning on the effective date of this act, any properties

17  that may be annexed by the City of Fort Myers and located

18  within the District shall remain the responsibility of the

19  District until January 1 of the following year, at which time

20  the City shall assume the responsibility for fire control and

21  such property shall no longer be a part of, or subject to, the

22  taxing authority of the fire control taxing District. The

23  municipal governing authority shall enter into an agreement to

24  purchase, lease, or maintain real property and equipment of

25  the District, if it is located within the area so annexed.

26  Such agreement shall be reached by negotiated settlement.

27  Should the City and the fire control taxing District not be

28  able to reach a negotiated settlement, then the City shall

29  have eminent domain authority for all real property owned by

30  the fire control District and annexed by the City. The

31  presently appointed or elected commissioners of the District

  1  who reside within the areas annexed by the City of Fort Myers

  2  shall continue to serve as the commissioners of the District

  3  until the local governing authority assumes responsibility for

  4  the lands so annexed.

  5         Section 2.  This act shall take effect upon becoming a

  6  law.
