3 Authority, formerly known as the Oklawaha Basin
4 Recreation and Water Conservation and Control
5 Authority, Lake County; amending ch. 29222,
6 Laws of Florida, 1953, as amended; providing
7 conditions for the authority's election of
8 officers; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 4 of chapter 29222, Laws of
13 Florida, 1953, as amended by chapters 57-1484, 59-1466,
14 63-1507, 65-1787, 69-1209, and 2000-492, Laws of Florida, is
15 amended to read:
16 Section 4. A governing body for the Authority is
17 created, consisting of seven members who are residents of Lake
18 County, which body shall be known and designated as the "Board
19 of Trustees of the Lake County Water Authority," but which
20 shall be referred to as "the board." Five of the members must
21 each reside in a geographic area identical to a county
22 commission district, to be elected by the electors of the
23 county at large. Two of the members will be elected by the
24 electors of the county at large without regard to their
25 residence. On the second Tuesday following the general
26 election in 2000, the term of office of each person serving on
27 the board immediately before that date expires, and the
28 members of the board shall be elected by the electors of Lake
29 County in nonpartisan elections conducted by the supervisor of
30 elections pursuant to section 189.405, Florida Statutes, in
31 accordance with the Florida Election Code, chapters 97 through

1 106, Florida Statutes, beginning with the general election in
2 2000, for terms of 4 years beginning on the second Tuesday
3 following the general election. For purposes of staggering
4 terms, the members elected in 2000 from odd-numbered areas and
5 the at-large member receiving the higher number of votes shall
6 be elected to 4-year terms and the members elected from
7 even-numbered areas and the at-large member receiving the
8 lower number of votes shall be elected to 2-year terms.
9 Thereafter, each member shall be elected for a term of 4
10 years, except that a person may not be elected to more than
11 two consecutive 4-year terms. At the first meeting in December
12 of each year or, during a year in which there is a general
13 election, at a meeting held no later than 30 days after the
14 general election if the meeting and the election of officers
15 have been advertised properly, the board shall select one of
16 their number as Chair and one as Vice Chair of the board. The
17 Clerk of the Circuit Court of Lake County shall act as
18 Secretary and Treasurer of the board without any additional
19 compensation. In the event the provision pertaining to the
20 duties of the Clerk of the Circuit Court is for any reason
21 held to be invalid, the board may select one of its members to
22 serve as its Secretary and Treasurer, or it may appoint a
23 nonmember of the board as its Secretary and Treasurer, and
24 such nonmember shall receive compensation commensurate with
25 the responsibilities as determined by the board. The board
26 shall select a nonmember to serve as Executive Director of the
27 Authority, and such nonmember shall receive compensation
28 commensurate with the responsibilities as determined by the
29 board. The board shall require a surety bond of any person,
30 including the Clerk of the Circuit Court, who shall act as
31 Secretary and Treasurer of the board, in an amount to be fixed

1 by the board, which bond in the case of the appointment of the
2 Clerk of the Circuit Court or a member of the board shall be
3 in addition to the bond furnished by such person as Clerk of
4 the Circuit Court or as a member of the board, and the premium
5 thereon shall be paid by the board as a necessary expense of
6 operation.
7 Section 2. This act shall take effect upon becoming a
8 law.
