15 On page 18, between lines 30 and 31,

17 insert:
18 (e) To minimize the impacts of phosphate mining on the
19 waters and uplands in the most sensitive areas around the
20 headwaters of Charlotte Harbor and to reduce the risks that
21 Charlotte Harbor and its tributaries are affected by spills
22 from phosphate mining clay settling ponds, there shall be a
23 buffer wherein no mining activity shall take place within the
24 100 year floodplain of the Peace River, Horse Creek, the
25 Myakka River and each of their tributaries, south of the
26 northernmost boundary of Township 35 South, Ranges 22, 23, 24,
27 25, 26 East of Latitude North 27 Degrees 28 minutes. In no
28 instance, however, shall the buffer be less than a distance of
29 1000 feet from the mean high waterline nor greater than 1750
30 feet from the mean high waterline of the Peace River, Horse
31 Creek, Myakka River and each of their tributaries. Where this

1 section prohibits the exploitation of otherwise commercially
2 viable phosphate deposits, and phosphate mining rights in the
3 prohibited area are owned by an entity seeking approval for
4 phosphate mining in an area contiguous with the prohibited
5 area, the department may consider the prohibited area as
6 preserved land when reviewing mine reclamation plans under
7 chapter 378 and when it is otherwise appropriate under
8 applicable statutes and rules.
