1 A bill to be entitled
2 An act relating to assault; amending s. 901.15,
3 F.S.; providing a law enforcement officer may
4 make an arrest without a warrant under certain
5 circumstances when an assault is made upon
6 another person in that person's workplace;
7 providing for immunity from civil liability
8 under certain circumstances; providing a
9 definition; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Subsection (9) of section 901.15, Florida
14 Statutes, is amended to read:
15 901.15 When arrest by officer without warrant is
16 lawful.--A law enforcement officer may arrest a person without
17 a warrant when:
18 (9) There is probable cause to believe that the person
19 has committed:
20 (a) Any battery upon another person, as defined in s.
21 784.03.
22 (b) An act of criminal mischief or a graffiti-related
23 offense as described in s. 806.13.
24 (c) An assault upon another person, as defined in s.
25 784.011, when the assault is committed in the workplace of the
26 person assaulted. A law enforcement officer who acts in good
27 faith and exercises due care in making an arrest under this
28 paragraph is immune from civil liability that otherwise might
29 result by reason of his or her action. For the purposes of
30 this paragraph, the term "workplace" means a single physical
31 location where business is conducted or services or operations

1 are performed and includes the area within 100 feet of that
2 location.
3 Section 2. This act shall take effect upon becoming a
4 law.
