13         Senate Amendment (with title amendment) 
14         On page 1, line 24, through page 3, line 14, delete
15  those lines
16  
17  and insert:  
18         Section 1.  Notwithstanding the October 2, 2003, repeal
19  of said subsection scheduled pursuant to the Open Government
20  Sunset Review Act of 1995, subsection (16) of section 409.175,
21  Florida Statutes, is amended to read:
22         409.175 Licensure of family foster homes, residential
23  child-caring agencies, and child-placing agencies; public
24  records exemption.--
25         (16)(a) The following information contained in the
26  licensing file held by the Department of Children and Family
27  Services regarding a foster parent applicant and such
28  applicant's spouse, minor child, and other adult household
29  member department is exempt from the provisions of s.
30  119.07(1) and s. 24(a), Art. I of the State Constitution,
31  unless otherwise ordered by a court: the home, business, work,

SENATE AMENDMENT Bill No. CS for SB 1444 Amendment No. ___ Barcode 471812 1 childcare, or school addresses and, telephone numbers;, social 2 security numbers;, birthdates;, medical records; the floor 3 plan of the home; and photographs of such persons. If a foster 4 parent applicant does not receive a foster parent license, the 5 information made exempt pursuant to this paragraph shall 6 become public 5 years after the date of application, except 7 that social security numbers and medical records shall remain 8 exempt from the provisions of s. 119.07(1) and s. 24(a), Art. 9 I of the State Constitution. This exemption applies to 10 information made exempt by this paragraph before, on, or after 11 the effective date of the exemption. 12 (b) The following information held by the Department 13 of Children and Family Services regarding a licensed foster 14 parent and the foster parent's spouse, who are licensed under 15 this section to be family foster parents and of their spouses, 16 their minor child children, and other adult household member 17 members is exempt from the provisions of s. 119.07(1) and s. 18 24(a), Art. I of the State Constitution, unless otherwise 19 ordered by a court: the home, business, work, childcare, or 20 school addresses and telephone numbers; social security 21 numbers; birthdates; medical records; identifying information 22 about such persons in neighbor references; the floor plan of 23 the foster home; and photographs of such persons. If a foster 24 parent's license is no longer active, the information made 25 exempt pursuant to this paragraph shall become public 5 years 26 after the expiration date of such foster parent's foster care 27 license, except that social security numbers and medical 28 records shall remain exempt from the provisions of s. 29 119.07(1) and s. 24(a), Art. SENATE AMENDMENT Bill No. CS for SB 1444 Amendment No. ___ Barcode 471812 1 regarding such foster parent's spouse, minor child, or other 2 adult household member shall not become available to the 3 public 5 years after expiration of such foster parent's 4 license and shall remain exempt from the provisions of s. 5 119.07(1) and s. 24(a), Art. I of the State Constitution. This 6 exemption applies to information made exempt by this paragraph 7 before, on, or after the effective date of the exemption. 8 (c) The name, address, and telephone number of persons 9 providing character or neighbor references regarding foster 10 parent applicants or licensed foster parents held by the 11 Department of Children and Family Services are exempt from the 12 provisions of s. 119.07(1) and s. 24(a), Art. I of the State 13 Constitution and any identifying information about such 14 persons contained in similar sensitive, personal information 15 that is provided to the department by such persons. This 16 subsection applies to foster parents whose homes are licensed 17 under this section, including, but not limited to, all 18 individuals who were foster parents and became adoptive 19 parents.
